They carry on these affairs in exotic locales known for banking secrecy and regulations that make it possible to hide billions of dollars in marital assets. Even the most financially sophisticated wives and their divorce lawyers are often unable to keep up with the growing asset protection industry and the ruthless men to whom they cater. Combating this trend, divorce lawyers and defrauded ex-wives have turned to lawyers who specialize in piercing the opaque world of offshore companies and trusts to recover assets from high net worth individuals and those who assist them. The release of the “Panama Papers” and “Paradise Papers” exposed much of the “wealth management” industry and its clientele as co-conspirators in a high-stakes shell game to conceal trillions of dollars of assets from taxing authorities, corrupted government regimes, creditors and, increasingly, the clients’ own spouses. In “Capital Without Borders: Wealth Managers and the One Percent,” Brooke Harrington notes that “through wealth managers’ skillful use of tools such as trusts, foundations and corporations, the game of ‘now you see it, now you don’t’ can go on almost indefinitely …” Many firms now advertise “pre-divorce planning” services designed to transfer assets out of a spouse’s reach. These schemes may place marital assets into offshore companies and trusts in which the divorcing wife receives a one-half ownership interest, but no right to distributions. Then, while the ex-husband is drawing “consulting fees,” his ex-wife is handed a large year-end tax liability with no ability to pay it. The scheme concludes when the ex-husband disingenuously offers to buy the company interest back and pay the taxes—all at a fraction of what his ex-wife was entitled to receive. In these divorce cases, trusts, companies and other entities maintained by the husband to hold assets should be primary subjects of inquiry. Legitimate estate and tax planning does exist and most practitioners in the field are honest brokers of a vital service. However, for the unscrupulous, “estate planning” is but a euphemism to describe asset concealment to defraud unsuspecting wives and others. Once the seeds of marital discord have been sown, if the wife has not been involved in these transactions or communications, it is more than likely that the husband enlists the wealth management professionals to divest his wife from marital property. Divorce counsel should therefore explore the husband’s accounting and legal engagements, however brief or seemingly minor. Individuals Enlisted in the Schemes Are Often Key to Successful Settlements Men who engage in these schemes often fit a standard profile—narcissistic, with an inflated sense of self-importance and a complete lack of empathy. They are often highly intelligent and believe passionately that they are doing nothing wrong. They do not fight over money, for there is more than enough marital wealth for everyone to live comfortably. They engage in protracted litigation to exercise power over and to punish their ex-wives, to exert control over their children and to secure loyalty from their family members. However, because their schemes require trusted individuals to act as nominees for entities or accounts, these men often enlist friends and family members to carry out their asset concealment activities. One such husband pursued refused to pay child support and to satisfy a judgment for property division for millions of dollars. He was pursued through two jurisdictions before he settled abroad where his conduct was essentially legally condoned. He showered his children with lavish gifts, and insisted that they come to visit him before he would pay for educational expenses and even regular dental cleanings. He threatened to miss college graduations and other milestones in his children’s lives before he would pay his ex-wife as ordered by the court. He was confident that he and his family had squirreled away the marital wealth in an impenetrable offshore structure. However, by bringing claims against those that facilitated the scheme, which brought these seemingly more rational actors to the bargaining table, a significant global settlement was obtained. The bottom line is that the world does not end at a country’s borders. There are methods of pursuing offshore assets that are focused on flipping the leverage of the seemingly impenetrable offshore structure and forcing participants in the scheme to essentially “buy the judgment.” Divorce lawyers should reach out to networks of specialized asset recovery lawyers for assistance in navigating the underworld of global asset protection schemes. The international networking and professional growth organization, aimed at women in the restructuring and insolvency industries, announced the names of its five-member executive board and its ten-member management committee on 17 September. IWIRC also published the names of its new regional directors, directors at large, as well as its standing committee and vice directors. Carrianne Basler , a managing director at AlixPartners in Chicago who was vice chair, succeeds outgoing chair Jennifer McLemore . Michelle Pickett , a partner at PricewaterhouseCoopers in Toronto, Canada, becomes the new vice chair. McLemore will remain on the board as immediate past chair. The executive board also includes Leyza B. An individual acknowledgment of me is really a reflection of being surrounded by a consistently great team, long term. It may seem cliché to say so, but I have been fortunate to, first, have had hard-working professional colleagues in my early days, and later, to have had a hand in building up a team of first-rate attorneys, paraprofessionals, and staffers to do high-level work. As a subject-matter expert, you routinely deliver presentations on international insolvency matters, creditors’ rights, enforcement of judgments (both domestic and foreign), assorted bankruptcy topics, workouts and secured transactions. How do you prepare for these presentations? I am admittedly a legal information junkie, so I am constantly consuming articles, advance sheets, webinars, and the like. If you stay on top of new developments it is far easier to prepare for a presentation. As far as the actual delivery of the information, I try to find a way to explain the material in a conversational way and give examples that are likely to occur. Why do you think it is important for attorneys like yourself to get involved in public speaking related to their subject-matter expertise? There are two benefits about speaking on topics you know well. Firstly, it is an opportunity to practice the methods of conveying that information to a captive audience. Today, you may present to a room of conference attendees, and tomorrow it might be the judge in your most important case. Secondly, for litigators, this kind of public speaking creates credibility both in the market for clients, as well as interactions with the other participants in the case. When did you know you wanted to practice law? Was it something you always aspired to do? I thought about law school and practicing law while in my undergraduate studies. I was working toward my finance degree, took a class in business law and it just made complete sense. I had no lawyers in my family, so the joke was that my struggles with calculus led me to the law. Who has had the biggest influence on your law career? In both my legal career and my life, I have been most influenced by my wife. She is a brilliant health care lawyer and she is the best sounding board for me. What advice would you give to young lawyers who are deciding what type of law they want to practice? My first piece of advice is to be brutally honest with yourself. I mean your real self, not the person you want to be or the person your friends or family think you are or want you to be. For instance, if you detest confrontation, it will be a hard lift to be a successful trial lawyer. A process of elimination can also come in handy, such as litigation versus transactional. Even within litigation, can you project yourself working in an area dominated by statutes and regulations (think tax, health care, bankruptcy, environmental), or would you be better suited for a more fact-intensive litigation area (think negligence, injury, and other torts)? Sequor Law successfully defends a $19.5 million injunction protecting offshore-dissipated escrow funds, affirmed by Florida's Third District Court of Appeals in February 2019. Third District Court of Appeals Affirms $19.5 Million Mandatory and Prohibitory Temporary Injunction Order in Case No. 17-01358 CA 22 – Hakim v. Tawil et al. Open Case Results Open June 17, 2020 1 minute read Sequor Law Sequor Law represented the Plaintiff in successfully obtaining a $19.5 million temporary mandatory and prohibitory injunction to protect the res of a constructive trust claim, which funds had been dissipated from Miami escrow accounts to offshore accounts during the pendency of the case. The Florida Eleventh Judicial Circuit Complex Business Litigation Court required the Defendants to return the $19.5 million to a Miami escrow account and prohibited further transfer of the funds. The Defendants appealed the adverse injunction order over the escrow funds by arguing, among other things, that the Court should not have entered the injunction without first determining it had personal jurisdiction over the defendants. Sequor Law represented the Plaintiff as Appellee in the appeal. After considering the briefing and oral argument, on February 26, 2019, the Third District Court of Appeal affirmed injunction order in a written opinion. Attorney Spotlight – Get to Know David Short Open Attorney Spotlight Open October 9, 2025 2 minutes read Sequor Law 1. What inspired you to pursue a law career? I don’t think that it was a matter of inspiration, but of choice – I wanted a career that would allow me to make the world a better place, and law was one of the ways that I thought I might do so. 2. Why did you choose the areas of law that you practice? Like many lawyers, it wasn’t entirely purposeful. I started as a generalist and focused on opportunities that were both challenging and rewarding. This naturally led to anti-corruption and anti-fraud work, in part because of the firms I came to and the people I worked with. 3. What skills do you draw upon when it comes to your specific practice areas? Writing, more than anything. Being able to clearly communicate ideas and principles in an organized, digestible way that is tailored to the recipient or recipients – whether a client, opposing counsel, colleague, or a particular judge – is invaluable. But a key part of that is rewriting – being able to adapt and refine someone else’s writing while trying to preserve their voice as much as possible. 4. What is the most rewarding part about your job? There is a quietly and deeply satisfying feeling at the realization that something I thought about and wrote has become part of the common law in some way. This happens in winning, of course, at least if the judge both rules in your favor and does it for the reasons that you proposed. But it can happen even on a loss – you can at least guide the court away from adopting a particularly bad interpretation of a law, even if the outcome is not what you hoped for. 5. Tell us about a mentor who made an impact on your career. Janice Platt, a senior staff attorney at the sixth circuit, was relentless in helping me improve my writing skills. Endless, continuous, and tailored feedback to make me as effective in different styles as possible. That was the foundation I needed to find my own voice as a lawyer, and it made me much better at understanding why courts use certain words or phrases. 6. If you weren’t practicing law, what would you be doing? Likely scientific research. It was graduate school or law school, but law school presented better career opportunities for me. 7. What might people be surprised to learn about you? I used to create mods for video games. Only one set of mods really took off, and that was for a relatively niche game, but I poured a couple thousand hours into that hobby over several years between learning the relevant modding commands, researching the underlying ideas I wanted to implement, working on pixel art, and then implementing and testing my ideas until they were ready for release. 8. What is a good book or article you read recently? I’m currently working my way through The Wind’s Twelve Quarters, by Ursula LeGuin. She’s a wonderful writer. A common theme through the short stories is how culture informs perception – even when a narrator isn’t unreliable, they still might misapprehend something because a difference that someone else might find important doesn’t matter (or doesn’t even exist) from the primary narrator’s point of view.
