He has worked on complex Chapter 15 bankruptcy matters involving the recovery of hundreds of millions of dollars hidden through layered international structures. He earned his Juris Doctor, cum laude, from the University of Miami School of Law, where he served as a Dean’s Fellow for a First Year Contracts Course and was active in several organizations such as, the Brazilian Law Student Association and the Fashion Law Society. He is fluent in English, Spanish, and Portuguese. Noah Rosenblum concentrates his practice on international commercial litigation, asset recovery, and financial fraud. While in law school, he served as a judicial intern for Judge Miller of the Florida Third District Court of Appeal and as a student clinician in the University of Miami Bankruptcy Clinic. He earned his Juris Doctor, cum laude, from the University of Miami School of Law, where he received the Patricia Redmond Scholarship and co-authored a published article in the International Law Quarterly addressing Section 1782 judicial assistance in international arbitration. Trove of Missing Art Heads to Auction Open In the News Open October 28, 2017 3 minutes read Sequor Law A Henry Moore sculpture and a Rufino Tamayo painting are among recovered art works that may be auctioned at Sotheby’s By Kelly Crow Former Banco Santos president Edemar Cid Ferreira once covered the walls of his São Paulo home with Man Ray photographs, Louise Bourgeois prints and paintings by Jean-Michel Basquiat, Francis Picabia and others. But when Brazilian authorities arrested Mr. Ferreira in 2006 for an alleged $1 billion money-laundering scheme, the walls were bare. The vanished collection set off a global scavenger hunt, with investigators and creditors chasing leads long after Mr. Ferreira was convicted of money – laundering and sentenced in federal criminal court in Brazil to 21 years in prison. Mr. Ferreira has appealed the case and declined, through his lawyer, to comment. Mr. Ferreira, the president of Banco Santos, during the World Economic Forum in Davos, Switzerland in 2004. This month, U.S. authorities announced a breakthrough, saying they had rounded up 95 works Mr. Ferreira once owned that together are worth at least $10 million. The art was in warehouses across France, Panama, England and the Netherlands, according to the U.S. Attorney’s Office for the Southern District of New York. Two paintings in the group were in galleries in New York. Joon Kim, the Acting U.S. Attorney, who said Mr. Ferreira’s art had been “used to mask an audacious criminal scheme,” signed documents turning the trove over to a Brazilian judicial administrator handling the estate of Banco Santos, which failed in 2005. The bank’s estate, which is seeking to compensate creditors, plans to enlist Sotheby’s to auction some of the works, said Arnoldo Lacayo, a lawyer with Sequor Law, a Miami firm helping the bank’s estate track down Mr. Ferreira’s assets. A Sotheby’s spokeswoman confirmed that the auction house has been asked to review the works for potential sale. Major pieces include Henry Moore’s “Woman,” a life-size bronze figure that had been stored in France, as well as Rufino Tamayo’s abstract view of a couple, “Casal de Marcianos 1975 (Two Figures),” which was stored in Florida. There also is a Lucite cube sculpture by Anish Kapoor and works by Brazilian mainstays Adriana Varejão, Vik Muniz and Jac Leirner. Among the older works is an etching by Eugène Delacroix. The fate of Helen Frankenthaler’s 1965 blue-and-gold abstract, “Sea Strip,” offers a glimpse into the circuitous path of some of the art. Mr. Ferreira paid Christie’s $197,900 for “Sea Strip” in late 2004 —a year before his bank failed and a time when authorities said he was starting to ship crates of art to warehouses in Europe for safekeeping. Later, a friend of his wife sold “Sea Strip” to Edward Tyler Nahem Fine Art in New York for an undisclosed sum. John Cahill, a lawyer for the gallery, said Mr. Nahem had been told that the painting was from a corporate collection. Once alerted to its true origins, Mr. Nahem got into a title dispute with the bank’s estate, Mr. Cahill and Mr. Lacayo said, because the dealer had bought the work in good faith. Both sides said they have since reached a settlement to sell the work jointly. Right now, the Frankenthaler is the only recovered work that isn’t immediately headed to Sotheby’s, Mr. Cahill said. Before this month, only a handful of works from Mr. Ferreira’s collection had been found and returned—including a Roman statue and Basquiat’s 1982 “Hannibal,” a skull portrait on an orange background. The work, with its dark slashes, spiky lines and splotches of bright color, is considered a signature piece by Basquiat, who started out as a graffiti artist. Mr. Ferreira bought the painting in 2003 and had it shipped from the Netherlands to a New York warehouse in 2007 after his conviction, authorities said. Why did you choose to become a dual-licensed attorney in Florida and Brazil? I decided to become a licensed attorney in the U.S. to pursue and advance my career in international law. Born and raised in Brazil, I worked as an attorney for a few years in São Paulo, mainly with international clients. There, I saw that studying the common law system and being licensed in the U.S. would be a great asset that few attorneys have the chance to add to their skillset. I specifically chose Florida for two reasons: Florida is the gateway between Latin America and the rest of the world, and I am absolutely passionate about Miami. Why did you elect to join Sequor Law? Sequor Law offers many advantages that an attorney would generally seek in a law firm. Foremost, is that I work with some of the top practitioners in the area, and nothing compares to learning from the best. When it comes to asset recovery and cross-border insolvency, my colleagues are often contributing to developing case law. Also, the international asset recovery practice is interesting and rewarding. The investigative work involved is fun, and representing people who were defrauded or otherwise done wrong is personally fulfilling, believing, as I do, that the practice of law is an instrument of justice. What practice areas do you focus on? My practice is focused on international asset recovery–from foreign judgment domestication and enforcement to fraud and divorce cases–as well as cross-border insolvency. How does having legal experience in another jurisdiction impact your skillset and ability to help clients? Having experience as a Brazilian attorney while working on international cases as a U.S. attorney is like having an extra set of tools in my tool-belt. It is helpful in a variety of ways. For example, when representing a Brazilian client, speaking the same language goes a long way, and I am not just referring to the fact that we both speak Portuguese; I mean understanding the cultural nuances, the legal terms, the legal system, and so much more. Precise communication is a tremendous advantage for both the client and the firm. In addition, expertise in both U.S. and Brazilian law is invaluable when they are the two sides of the same coin, as they often are in our cases. That sort of in-depth knowledge comes in handy while developing the case strategy with the client and prosecuting the case in the US. Could you provide an example of how that skill set helped forward client objectives? Just as some words only exist in Portuguese–such as “saudade”, meaning the empty feeling in your heart when you miss a loved one– some Brazilian legal concepts are difficult to translate and explain if one is not familiar with comparable terms in English. A good example of how that knowledge is key to forwarding clients’ objectives and one I encounter in my daily practice, involves deciphering the details surrounding a Brazilian judgment in a judgment domestication and enforcement action in the U.S. First, the client can make a more informed decision when the process in the United States is explained in familiar terms, with greater attention to the diverging points, such as, what are the enforceable assets of the debtor. Second, efficiencies are greatly increased when the attorney can read legal documents in their original language and knows what other documents might have key additional information. Third, the attorney can rapidly identify inaccurate allegations presented by the judgment debtor and prevent them from causing delays in the case. Sequor also in October handled a Chapter 15 petition for Brazilian media company Minuano Comunicações e Produções Editorias Ltda., which sought recognition of its involuntary insolvency case in Brazil as it worked to recover assets that might have been diverted to banks in Miami and New York. The fledgling law firm, which former shareholders of Astigarraga Davis Mullins & Grossman PA formed in April 2017 after that firm split in two, has quickly grown into the favored counsel of many Brazilian companies, financial institutions, sovereign entities and state-owned enterprises seeking representation for insolvency, financial services litigation, financial fraud and asset recovery. Sequor, which on its website says its name in Latin means “to pursue, to chase, to attain,” has been involved in 13 Brazilian insolvency cases since 2017, according to shareholder Leyza B. Florin . About 60% of Sequor’s total business focuses on Chapter 15 cases, and 80% of those filings are for Brazilian insolvency cases, said Blanco, who joined the firm in June 2018 from Orlando, Fla.-based GrayRobinson PA. In addition to Minuano and Brasagro, the firm has represented sugar and ethanol producer São Fernando Açúcar e Álcool Ltda. (Aug. 22), construction company Knijnik Participações SA (July 24), securities holder Schahin Holdings SA (July 26), process control equipment maker Smar Equipamentos Industrias Ltda. (Feb. 28) and rubber tire product maker Marangoni Tread Latino America Indústria e Comércio de Artefatos de Borracha Ltda. (Feb. 15) in Chapter 15 cases in 2019. The “Southern District of Miami is a popular court for Brazilian filings because of their many connections to Miami,” Blanco said. “It’s the gateway to the Americas and home to a great deal of Brazilian offshore business. It is a natural conclusion that in looking to track offshore transactions from Brazil that Miami would be a likely first place to look.” Sequor’s Chapter 15 roots also go deep, with founding shareholder Gregory S. Grossman filing the first Chapter 15 case in Florida, for a Barbadian financial institution while he was at Astigarraga Davis. The predecessor firm handled a fair amount of Brazilian Chapter 15 proceedings, and there have been more to go around lately. Blanco pointed to an apparent rise in fraud-related cases that require investigation as the root of an increase in Chapter 15 filings. In addition, she said more Brazilian insolvency advisers are familiar with Chapter 15 as a tool to assist that country’s bankruptcy courts in investigating and obtaining assets that may have been transferred outside the country to defraud creditors. The Operação Lava Jato, or Operation Car Wash, criminal investigation that began in 2014 ultimately embroiled state-controlled Petróleo Brasileiro SA and construction company Odebrecht SA and led to indictments and convictions of politicians and professionals as it probed alleged money laundering, corruption, embezzlement and bribery. Among the politicians indicted and jailed were former Brazilian presidents Fernando Collor de Mello, Michel Temer and Luiz Inácio Lula da Silva. Odebrecht CEO Marcelo Odebrecht also was sentenced to prison. Bribes and improper conduct by defendants caused a domino effect with insolvencies and liquidations of companies, Blanco said. Companies or individuals moving company assets offshore and outside Brazil led to many Chapter 15 filings, Blanco asserted. Brazil’s recession and severe economic crisis, which began in 2014, also contributed to the financial distress that has led to more filings, she added. “Sequor was formed to offer clients the relentless global pursuit to recover assets lost to bad actors,” said Blanco, who has been working on bankruptcy, restructuring, insolvency and Chapter 15 cases since 1997. “That pursuit often occurs through the use of Chapter 15 cross-border insolvency cases and other asset recovery tools.” The law firm employs 15 full-time attorneys and one of counsel. What skills do you draw upon when it comes to your specific practice areas? An emphasis on diligence has always been a guiding principle in my work. I firmly believe that the harder you work, the luckier you become. This means approaching every problem with thoroughness and methodical precision. By staying consistent and meticulous, I ensure that every detail is considered, and every potential solution is explored. Through this, it not only enhances the quality of my work but also increases the likelihood of success. 4. What is the most rewarding part about your job? One of the most fulfilling parts of my job is knowing that the work I do has a positive impact. I’ve been incredibly lucky to have had two fantastic mentors early in my career: the Judges for whom I clerked for. Advanced Recovery Strategies for Domestic & International Judgments Representative Representative Cases Representation of Peru in Kleptocracy Case Against Former Head of State Sequor Law represented the Government of Peru in litigation in Miami, Florida, where the plaintiff sought to attach the aircraft in which the President of Peru would travel to the United States. While asserting defenses under the Foreign Sovereign Immunities Act, including insufficient service of process, lack of personal jurisdiction, and failure to state a claim, the firm also argued that Peru was immune from attachment and suit. The court held that the aircraft was “military hardware” and therefore not subject to attachment. Representation of Instrumentality of the French Government in Asset Recovery Matter Sequor Law represented Créances, S.A.S. (“CDR”), successor to Société de Banque Occidentale (“SDBO”) and an instrumentality of the Republic of France, in a matter involving a nearly US$100 million fraudulent loan transaction that led to the sale of the collateral land without repayment.
