How to Answer Tough Law School Interview Questions Open In the News Open May 10, 2018 5 minutes read Sequor Law By Ilana Kowarski In law school interviews, it’s important to explain why you’re a strong candidate, experts say. Trial lawyers and appellate lawyers are often asked questions by judges who expect an immediate response. These attorneys cannot waver over what to say; they must improvise and come up with a compelling argument. Some of the most influential attorneys in U.S. history are famous for their ability to deliver captivating, off-the-cuff speeches. Before he joined the U.S. Supreme Court, Justice Thurgood Marshall was a litigator known for his powerful speeches during civil rights cases. And Clarence Darrow – a trial attorney who represented clients in some of the most controversial legal disputes of the early 20th century like the “Scopes monkey trial” – was often lauded for his ability to sway juries with his remarks. Law school admissions committees strive to identify students who have the potential to have a lasting positive impact on the legal profession. That’s one reason why they look for applicants who have the capacity to speak with authority and conviction in a way that inspires others. But law schools also have a more pragmatic reason to recruit students with a silver tongue: Oral advocacy is a crucial part of many legal jobs. Attorney Andrew Ittleman, a founder and partner with the Fuerst Ittleman David & Joseph law firm in Miami, says that showing poise during a law school admissions interview is a must. “[In] exercises like that, you know, whether it’s sitting in an interview or arguing in court, you want to get to a place where you can be loose going in,” Ittleman says. “It’s not a test… Nobody is grading you the way that they would on a test. They want to see who you are as a person.” Ittleman advises law school applicants to conduct a few practice interviews with people they trust who can provide honest feedback. “Go through a couple of dry runs,” he suggests. Ittleman says practice interviews help students discover the right words to use to clearly express their thoughts. With that in mind, attorneys say that law school applicants should figure out how they’d like to answer the following questions before their admissions interviews. Why do you want to become a lawyer? Experts say this is a question that J.D. applicants must have a compelling answer for, because law schools are wary of admitting students who view law school as a delay tactic to avoid making a career choice. “I believe strongly that we should prepare and produce graduates who passionately want to be lawyers, because I believe lawyers who are passionate about what they are doing will be happy lawyers,” says Kathleen Boozang, dean of the Seton Hall University School of Law in New Jersey. “And so I am looking to see that the student is going to law school because they are inspired to go to law school, as opposed to [because] they really can’t think of anything else to do.” Why are you applying to this particular law school? “Students should go into interviews knowing everything on that school’s website, its values, how it describes itself, who the star professors are, etc.,” says Ella Tyler, a retired lawyer who works as a tutor for Varsity Tutors, a virtual education platform. “Law requires preparation and research, so if you showcase those skill sets in your interview, it’s proof that you have what it takes to be a lawyer.” What kind of law are you most interested in practicing? What is your dream law job? If you want to use a law degree in an unconventional way, such as in a policy job or a nonlegal business position, you may be asked: Why do you need a law degree? What would a law degree allow you to do professionally that you couldn’t do without the degree?Experts say law schools are looking for applicants who can clearly articulate how they intend to use a J.D., because these schools don’t want to admit students who lack a clear justification for investing the time, effort and expense that law school requires.“Law school is hard, it’s a lot of work, and you have to have the spark,” Boozang says. “You have to have a passion, you need to want to do it, and I want to just confirm that the student knows what they are getting into and that the desire is real.” What book are you reading at the moment, and what do you think of it? If you aren’t currently reading a book, you may be asked an alternative question: Who is your favorite author and why?Boozang says she asks questions like this to see whether a J.D. applicant is intellectually curious, enjoys the written word and can formulate a coherent argument about what he or she has read. The ability to analyze a text is a key skill for an aspiring lawyer, Boozang says.Questions of this type are also meant to reveal whether an applicant has a well-rounded personality that includes interests besides academics, Boozang says. She advises applicants to read the news and continue pursuing their extracurricular interests during the law school admissions process, because it gives them something interesting to discuss when they are asked personal questions.“I emphasize the importance to young people thinking about law school the need to be thinking about the world around them,” she says. What college paper are you most proud of? The thinking behind this question is that it allows a J.D. applicant to discuss a subject they are enthusiastic and knowledgeable about, Boozang says. This interview question illuminates the way an applicant thinks and clarifies whether they have the mindset of a future attorney, she adds.Boozang says a J.D. applicant who is asked this question should be prepared to answer follow-up queries about his or her paper, which may ultimately lead to a back-and-forth discussion with the interviewer. She says that the topic or thesis of the paper will be less relevant to the interviewer than whether the applicant is able to clearly explain his or her ideas and make a coherent argument. How would you contribute to a law school class? Experts say questions like this give law school applicants an opportunity to differentiate themselves from their competitors in the J.D. admissions process.Nyana Abreu, an attorney at Sequor Law in Miami, says the key to answering this question well is to talk less about academic statistics and more about who you are as a person.“That’s not an academic question, and I think that’s something that a lot of candidates miss – that when you’re given an opportunity to talk about yourself, they don’t want to know your GPA [and] they don’t want to know your test scores,” she says. “They already know all those types of things. They want to know something memorable about you. So I would say, think of that question as more of a first date question. A subsidiary of the Italian tyre conglomerate Marangoni has asked a Miami court to recognize bankruptcy proceedings it has entered in Brazil to investigate possible US assets. Marangoni Tread Latino America filed for Chapter 15 protection on 15 February in the US Bankruptcy Court in Miami, with Sequor Law partner Gregory Grossman advising. In the Chapter 15 filing, Marangoni Tread’s judicial manager Otávio De Paoli Balbino said he was appointed by the Second Civil Court of Lagoa Santa, Minas Gerais, on 25 January to investigate “detrimental” transactions between the company and its subsidiaries. Balbino, a partner at law firm Paoli Balbino & Barros Sociedade de Advogados, asked the court to recognize the Brazilian restructuring so he could investigate the company’s US dealings. Marangoni Tread filed judicial reorganization proceedings in the Lagoa Santa court in September 2017 and the case was accepted on 13 November. The company claimed it was hit by Brazil’s 2014 recession, low sales, payment defaults and a higher rubber price. It said it had about 58 million reais (US$15.6 million) and about 850 creditors at the time of filing. But the Brazilian court noted “many mistakes and inconsistencies” in the accounting records the company had provided, including an incomplete list of its managing director’s personal assets. The court tasked Balbino and accountant Cleber Batista de Sousa with investigating transactions between Marangoni Tread and its Italian owners, its one Argentinean subsidiary, and four Brazilian subsidiaries. Batista found “several inconsistencies between the balance sheets and the financial books provided” and concluded several transactions “had detrimental impacts to the debtor’s finances”. He also found the subsidiaries may have acquired products manufactured by Marangoni Tread for less than their production cost. Balbino said Marangoni Tread “may have had transactions with the US subsidiary of the (Marangoni) conglomerate and other American companies”. “I need to investigate the possibility that assets in the US may have been acquired using funds belonging to the debtor,” Balbino added. Marangoni Tread was incorporated in 1998 and is owned by Italian companies Marangoni and Eurorubber. The company owned 51% of Marangoni Argentina and 99% of four Brazilian subsidiaries, but sold its shares in the subsidiaries “for little or no consideration” a year before its bankruptcy filing, according to the documents filed in the Chapter 15 case. Representative Representative Cases One of the Largest Ponzi Schemes in History Sequor Law represents the Joint Liquidators for Stanford International Bank, Ltd. (“SIB”) (in Liquidation). SIB, a bank located in Antigua that primarily sold certificates of deposit, played a central role in a worldwide Ponzi scheme, the second largest in history, perpetrated by Robert Allen Stanford, with losses to depositors estimated to exceed US$4.4 billion. Since May 12, 2011, when Marcus Wide and Hugh Dickson of Grant Thornton were appointed Joint Liquidators of the SIB estate in Antigua, Sequor Law has acted as co-general counsel with Caribbean counsel in global Asset Recovery efforts that have included recovering US$3.2 million from Panama, US$20 million from the United Kingdom, freezing assets in Antigua & Barbuda valued at US$212 million, launching a formal claims process, pursuing claims related to approximately US$330 million in frozen assets in Canada, Switzerland, and the U.K., filing damages claims valued at approximately US$5 billion against a Canadian bank, and initiating recovery efforts in Colombia against law firms and financial institutions. Recognition and Enforcement of UK Worldwide Freezing Order Sequor Law represents Novoship (UK) Limited and affiliated entities in a Judgment domestication and enforcement matter in Florida. After Novoship obtained approximately US$98 million in Judgments from the English High Court of Justice against a Venezuelan national and his companies for fraudulent acts relating to charter party contracts, and after the debtors breached a US$40 million settlement, Sequor Law obtained recognition of the English freezing injunction in Florida within 24 hours. The firm froze assets, commenced discovery before full recognition of the English Judgments, and uncovered nearly US$3.5 million in local bank funds and approximately US$1.5 million in Florida real estate. Coordinated proceedings in Florida, Switzerland, and London resulted in payment of the full settlement amount. Judgment Enforcement Against Sovereign in Bond Default Case Since 2008, Sequor Law has represented two major creditors of the Republic of Argentina in pursuing collection of more than US$1 billion in Judgments in Florida arising from Argentina’s 2001 bond default. Working with New York counsel, the firm pursued collection from assets located in Florida, including assets at the Miami office of Banco de la Nación Argentina, a bank wholly owned by the Argentine government. Representation of a Class of More Than 2,000 Victims of Caribbean Fraud Sequor Law represented a class of 2,232 victims of the Leadenhall Bank & Trust and Cash-4-Titles fraud in the British Virgin Islands and The Bahamas and recovered US$14.4 million. After Leadenhall entered liquidation and was sued in the U.S. District Court in Miami, the class obtained a final money Judgment of US$313 million in September 2007. Enforcement of that Judgment resulted in the US$14.4 million recovery, with approximately US$7 million more to be distributed thereafter. Proceedings Supplementary in Aid of Judgment Enforcement Sequor Law represented Robert J. Lodge and Robert K. Orr against SunTrust Bank. After obtaining an order for proceedings supplementary in aid of execution and conducting extensive discovery and depositions, the matter concluded in a favorable settlement in which significant funds were recovered by the Judgment creditor’s successor-in-interest. Deployment of International Treaties and U.S. Legal Claims Sequor Law represented a multinational Colombian food products company in recovering substantial losses for products obtained through fraud and deception. By deploying international treaties and U.S. domestic claims, the firm identified the products, prosecuted the defendants in the United States, and achieved a successful settlement. Representation of Peru in Kleptocracy Case Against Former Head of State Sequor Law represented the Government of Peru in litigation in Miami, Florida, where the plaintiff sought to attach the aircraft in which the President of Peru would travel to the United States. While asserting defenses under the Foreign Sovereign Immunities Act, including insufficient service of process, lack of personal jurisdiction, and failure to state a claim, the firm also argued that Peru was immune from attachment and suit. The court held that the aircraft was “military hardware” and therefore not subject to attachment. Representation of an Instrumentality of the French Government in Asset Recovery Matter Sequor Law represented Creances, S.A.S. (“CDR”), successor to Societe de Banque Occidentale (“SDBO”) and an instrumentality of the Republic of France, in a matter involving a nearly US$100 million fraudulent loan transaction that led to the sale of the collateral land without repayment. Sequor Law helped develop the strategy that ultimately led to the recovery of millions of dollars in real estate. Representation of the Government of Trinidad and Tobago in Bid-Rigging and Corruption Case Sequor Law represents the Republic of Trinidad and Tobago in related fraud and corruption proceedings in Florida, Liechtenstein, The Bahamas, Panama, and Switzerland. Representation of Caribbean Central Bank in Insurance Industry Fraud Sequor Law represented the Republic of Trinidad and Tobago in designing the legal strategy for the recovery of assets for the Central Bank of Trinidad and Tobago in the CLICO insurance company corruption scandal. China’s Defiance Over South China Sea Shows Limits of International Courts Open In the News Open July 12, 2016 2 minutes read Sequor Law The Philippines left The Hague in July 2016 with a sweeping win. A tribunal at the Permanent Court of Arbitration found that China had broken international law by building artificial islands to push its territorial claims hundreds of miles into the South China Sea. China's answer was just as blunt. It would not abide by the ruling, it had refused to take part in the proceedings, and it denied that the tribunal held any authority over what it called a territorial dispute. Forbes asked the obvious follow-up: what is a paper victory worth when the losing side refuses to recognize it? Tara J. Plochocki — today a Partner at Sequor Law and head of the Washington D.C. office — was quoted throughout the piece. The absence of China's consent, she noted, had been visible "from 14 years away": Beijing had signed a 2002 framework to resolve these disputes through negotiation, and it never agreed to let a tribunal decide questions of sovereignty. The whole story hinges on consent. Nations routinely agree to international arbitration in commercial matters and must live by the outcome. They are reluctant to agree to such arbitration when a dispute touches sovereignty. As the article notes, the United States has done the same thing China did, brushing off the International Court of Justice in the 1980s over Nicaragua and again in the 2000s in a death-penalty case involving a foreign national. Beijing is not the only sovereign to refuse to honor an unfavorable ruling. For businesses, Plochocki drew a practical line rather than a political one. China, she said, "is not an unreasonable place to do business — you can sign a contract there and have it enforced." Her caveat travels well beyond this case: companies contracting with state-owned enterprises should decide in advance on a dispute-resolution forum those enterprises have actually honored before. A favorable award means little if it lands somewhere the other side can ignore. Her closing observation captured the distance between winning and collecting. The Hague, she said, often serves as the court of international opinion; enforcing its judgments is a separate fight. Court Takes Under Advisement Motions to Convert MatlinPatterson Cases to Chapter 7, Says Decision Turns on Whether Wind-Down of Debtors’ Businesses Counts as ‘Species of Rehabilitation’ Open In the News Open April 8, 2022 3 minutes read Sequor Law At a hearing today in the MatlinPatterson Global Opportunities Fund debtors’ chapter 11 cases, Judge David Jones took under advisement the chapter 7 conversion motions filed by the foreign representative in the chapter 15 case of Varig Logistica SA, or VarigLog, and litigation plaintiff Gol Linhas Aéreas SA, referred to by its predecessor name, VRG. Judge Jones informed the parties that he would issue a decision on the conversion motions in the near term. HJDK Aerospacial S/A, which has asserted a $17.5 million claim against the debtors for failure of a portfolio company to repay certain loans in Brazilian civil courts, had also filed a statement in support of the conversion motion. Debtors’ counsel disputed the amount of HJDK’s claim at today’s hearing, saying that HJDK has only a $4.5 million claim. Judge Jones opened the hearing by informing the parties that his primary focus in considering the motions was whether the debtors had a “reasonable likelihood of rehabilitation” under the relevant provision of the Bankruptcy Code. Given the nature of the debtors’ business as investment vehicles for private equity investors, Judge Jones questioned whether using chapter 11 to wind down the investment vehicles by “clearing” the foreign litigation claims order to make payouts to investors and otherwise implement their business model was a “species of rehabilitation.” Judge Jones also said he would take into consideration whether staying in chapter 11 would result in a “substantial or continuing loss to or diminution” of the debtors’ estates. Judge Jones commented that it was “hard to see” how the administrative burn rate in the cases did not constitute some form of diminution, given the absence of revenues coming into the estates. Gregory Grossman of Sequor Law, counsel for the VarigLog foreign representative, said that the chapter 11 cases amounted to a “preplanned dissolution” of the debtors, and although that might be part of the debtors’ business model, this could not constitute a “rehabilitation” under the Bankruptcy Code. Grossman argued that treating such a preplanned dissolution as a rehabilitation under the Code would lead to “mischief” because companies could, prior to filing for chapter 11, modify their corporate governance documents to require dissolution by a date certain in order to pre-emptively defeat chapter 7 conversion motions. Tyler Robinson of Simpson Thacher, counsel for the debtors, argued that the rehabilitative purpose of filing the chapter 11 cases is to carry out the “intended purpose” of the debtors’ businesses, which “first and foremost” is to return capital to their investors. Robinson explained that the foreign litigation claimants had frustrated those efforts, ultimately causing the debtors to file the chapter 11 cases. Robinson said that in order to maximize the value of the estates, the debtors needed a “centralized process” for determining which parties held valid claims in order to ratably distribute estate assets. Robinson warned that it would be a “dangerous proposition” for the court to find that private equity funds and hedge funds should not be able to use chapter 11 to wind down their affairs. Robinson also argued that U.S. Supreme Court precedent supports the proposition that liquidation is an appropriate use of the chapter 11 process and that other courts have found a confirmable liquidating plan to be sufficiently rehabilitative to defeat a motion to convert. Arthur Steinberg of King & Spalding, counsel for VRG, argued that the debtors’ prepetition conduct justified conversion. Steinberg alleged that the debtors had covertly collateralized all their assets in favor of a nondebtor insider and transferred assets out of the estates prior to filing. Steinberg added that the debtors had no assets to liquidate, no revenue, no employees and “no public interest to protect.” According to Steinberg, the estates needed an estate fiduciary who is not “fronting for equity in the case” and that installing a chapter 7 trustee would cure the issue of “faithless fiduciaries” and satisfy the need for an independent investigator. Ralph E. Preite of Koutsoudakis & Iakovou, counsel to HJDK, told the court that after a decision by a Brazilian appellate court entered on Nov. 19, 2021, the appeals process had been exhausted and that the claim was therefore “final.” Elizabeth Curran of Schulte Roth & Zabel, conflicts counsel for the debtors, disagreed with Preite’s view that the litigation was over. According to Curran, the November 2021 decision related to a jurisdictional argument, and an appeal of the “full merits” of the matter is still pending.
